General Terms and Conditions

1. Scope

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded through the online shop of Manifix AG (hereinafter referred to as "MANIFIX.com", "we", "us" or "our") (hereinafter referred to as "Order"). These GTC apply to Manifix AG at: Churerstrasse 20, CH-8808 Freienbach.
MANIFIX.com reserves the right to amend the GTC. The version of the GTC valid at the time of the order shall be decisive and cannot be unilaterally changed for that order.

2. Offer

The offer is aimed at natural customers residing and legal customers having their registered office in Switzerland, Liechtenstein, and the European Union (hereinafter referred to as EU). Deliveries are only made to addresses in Switzerland, Liechtenstein, and the entire EU.
Price and assortment changes are possible at any time. The offer is valid as long as it is visible in the online shop and/or while stocks last. The illustrations shown in advertisements, flyers, the online shop, etc., as well as all information about the products, serve for illustration purposes and are non-binding. The specific information on the product packaging is decisive.

3. Price

Prices are quoted in Swiss Francs or EURO, including VAT and, if applicable, including advance recycling fees ("vRG").
The price in the online shop at the time of the order is decisive.

Ordered paid additional services such as gift wrapping, etc., are listed separately in the shopping cart and on the invoice.

4. Order

The presentation of products in the online shop is not a legally binding offer, but a non-binding online catalog or a non-binding invitation to customers to order the product in the online shop. MANIFIX.com reserves the right to restrict delivery quantities for certain products and to not execute delivery if the order is exceptionally heavy or voluminous.
An order is considered an offer to MANIFIX.com to conclude a contract.

A minimum order value of 16.50 EURO for EU customers and 16.50 CHF for Swiss and Liechtenstein customers applies per order. The minimum order values communicated in the online shop and the shipping cost policy apply.

For the first order, the total amount of the shopping cart must not exceed CHF 500.– or EUR 500,- when paying by credit card.

After submitting the order, the customer automatically receives an order confirmation, which documents that the order has been received by MANIFIX.com. If you wish to change your delivery address, please contact us at info@manifix.com. We will do our best to assist you in this matter. If we cannot change the address directly through our system, usually because the package has already been shipped, we unfortunately cannot make any changes to the delivery address.

MANIFIX.com is free to reject orders in whole or in part without giving reasons. In this case, customers will be informed and any payments already made will be refunded. Further claims are excluded, in particular, there will be no reshipment of products that cannot be delivered. Temporarily unavailable products cannot be reserved.

Already reduced items and gift vouchers are excluded from promotional codes.

Multiple promotions, discount campaigns or promotions offering free items cannot be combined. Only one promotion with a free item can be used per order. Should multiple uses still be displayed in the system, we reserve the right to adjust the order accordingly.

Furthermore, the respective voucher conditions apply.

5. Conclusion of contract

A contract is only concluded upon processing of the order at the MANIFIX.com logistics center. As soon as the order has been prepared for dispatch at the logistics center, the customer receives an order confirmation by e-mail.

6. Delivery

DELIVERY AREA

There is a logistics center in Germany, which is why, according to Deutsche Post, delivery can usually be achieved within 1-2 days.

DELIVERY TIME

We want you to receive your order as quickly as possible. Delivery times are visible in the online shop. It is not possible to specify an exact delivery time within the delivery period. Normally, you will receive your order within 1-4 business days. No deliveries are made on weekends and public holidays. Delivery times are estimates only. External events beyond our control can unpredictably change estimated delivery times. "External factors" may include, but are not limited to: extreme weather conditions and technical disruptions. Time deviations and the blocking of a specific delivery date are possible, especially on peak days with unusually high delivery volumes, whereby any claims for damages and other claims by the customer are excluded. Please also note that delivery times may be longer than usual during advertising campaigns.

No deliveries are made on Sundays and official German holidays.

If the customer is not present at the time of delivery and has not specified any special delivery instructions, the delivery will be deposited at the front door or at the reception desk or at the entrance door of the company. Delivery can also be made to a neighbor living in the same building. If the customer's mailbox belongs to a mailbox system, the delivery person will leave a collection invitation in the mailbox. The customer must then collect the delivery from the corresponding post office. The customer assumes responsibility for the delivered products, even if they were not directly received by them. Should the shipment be returned to MANIFIX because it was undeliverable or not collected from the post office, renewed shipping costs, if desired, must be borne by the customer.

SHIPPING COSTS

Shipping costs depend on the value of the ordered products (minimum order value excluding shipping costs). The shipping costs communicated in the online shop and the shipping cost policy apply. Shipping costs are listed as an additional item in the shopping cart and on the invoice.

Accordingly: Deliveries from 90 CHF or 60 EUR are free of shipping costs for the following recipient countries: Germany, Switzerland

Below 90 CHF or 60 EUR, a flat shipping fee of 8.00 CHF applies in Switzerland and Liechtenstein, and 4.50 EUR flat shipping fee for Germany. Insured parcel shipping is also available for Switzerland and Liechtenstein at a price of 18 CHF and for Germany at a price of 9.98 EUR.

Rest of EU:

Austria, Netherlands, Belgium: 5.50 €

Sweden, Denmark, Finland, Poland: 6.50 €

Luxembourg: 6.90 €

Croatia, Italy, Greece, Portugal, Romania, Spain, France: 7.50 €

Cyprus, Bulgaria, Estonia, Latvia, Ireland, Lithuania, Malta, Slovakia, Slovenia, Czech Republic, Hungary: 7.90 €

For orders under 7.00 € (excl. shipping costs), a minimum order surcharge of 1.00 € will be charged.

7. Warranty

MANIFIX.com guarantees the quality and durability of the products under the following conditions:
Dry, cool, and shaded storage
Protect from heat, especially temperatures above 25 degrees. Protect UV GEL FOILS from UV rays (even normal daylight contains UV rays).
Provided that the customer can prove compliance with these storage conditions, MANIFIX.com guarantees the defect-free nature of the ordered, unopened products for a maximum of 2 years from delivery.

MANIFIX.com may provide the warranty by optionally partially or fully replacing with an equivalent product, crediting up to the maximum sales price at the time of the order, or reducing the price.

There is a general right of return for defect-free and correctly delivered products. The warranty is explicitly excluded for products whose intrinsic quality (e.g., color quality) does not meet the customer's expectations, as well as for products ordered by mistake.

8. Returns

If the customer wishes to return products due to the 45-day money-back guarantee, or because they accidentally ordered the wrong products, the customer must bear the shipping costs incurred for the return. It should also be noted that only resellable foils plus a maximum of 1 (one) opened foil used for testing can be refunded, and sets must be returned complete.

The 45-day money-back guarantee for UV nail foils also only applies if they have been used with a MANIFIX UV Polish. Only with this polish will the UV nail foils last as advertised.

The 45-day money-back guarantee does not apply to free or gifted items. If a free promotional foil is received (always only one free gift per customer and only while stocks last), it must also be returned if the entire order is returned.

A free promotional foil / product will not be refunded.

The processing time for returns and refunds is up to 14 days.

9. Notification of Defects

If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery person, refuse acceptance, and write to support@manifix.com, without prejudice to their rights regarding defects. The customer is obliged to obtain a damage confirmation report from the delivery person. All transport damage must also be reported to MANIFIX.com immediately.

10. Payment Options

Payments must be made in Swiss Francs or EURO
ELECTRONIC PAYMENT OPTIONS

Credit card (Visa, Mastercard, American Express), KLARNA, Paypal, and SOFORTÜBERWEISUNG are accepted as payment methods.

REFUNDS, CREDITS, BALANCES

If the customer is entitled to refunds or other credits, these will be refunded to the payment method originally chosen at the time of order.

MANIFIX.com vouchers are under no circumstances for sale or auction. Only one voucher can be used per order.

11. Applicable Law and Jurisdiction

The legal relationship between MANIFIX.com and the customer is governed by substantive Swiss law, excluding conflict-of-law rules and the Vienna Sales Convention.
The place of jurisdiction for natural and legal persons is Freienbach.

12. Contact

We send review invitations by email to customers who explicitly agree to this on the checkout page when placing their order. Customers who do not tick the corresponding checkbox on the checkout page will not receive a review invitation for that order.
